California’s Most Ambitious Handgun Ban Now Underway

In 1976, the Brady Campaign, then known as the National Council to Control Handguns, said that the first part of its three-part plan to get handguns and handgun ammunition made “totally illegal” was to “slow down the increasing number of handguns being produced and sold in this country.”  This month, anti-gunners finally got that wish in California.

America’s two largest handgun manufacturers–Smith & Wesson and Sturm, Ruger–have announced that they will stop selling new semi-automatic handguns in California, rather than comply with the state’s “microstamping” law.  The law applies not only to entirely new models of handguns, but also to any current-production handgun approved by the state’s Roster Board, if such handgun is modified with any new feature or characteristic, however minor or superficial.

According to the Los Angeles Times, the law was “intended to help police investigators link shell casings found at crime scenes to a specific gun.”  That’s pure spin, however. In reality, the law, signed in 2007 by then-Gov. Arnold Schwarzenegger, is intended to terminate semi-automatic handgun sales and, over time, semi-automatic handgun ownership in the state.  “Microstamping” will solve few, if any crimes and it is only a matter of time before a proposal to expand the law to include other firearms will follow.

Meanwhile, the National Shooting Sports Foundation has announced that it and the Sporting Arms and Ammunition Manufacturers’ Institute have filed suit against the law in Fresno Superior Court “seeking both declaratory and injunctive relief against this back-door attempt to prevent the sale of new semiautomatic handguns to law-abiding citizens in California.”

Anti-gun activists often refer to California as the test bed for gun control laws they would like to have imposed throughout the country.  Thus, it goes without saying that gun owners outside California should anticipate “microstamping” efforts in their states, and do what it takes to elect pro-Second Amendment governors and state legislators to deny the anti-gunners additional victories.

However, making sure that what has happened in California doesn’t happen elsewhere is not the only reason to step up our election year efforts.  California accounts for 12 percent of the nation’s population and approximately eight percent of its handgun owners.  We owe it to our fellow countrymen–our Second Amendment brothers and sisters–to elect a pro-Second Amendment president and senators who will approve that president’s nominations to the federal courts, where California’s “microstamping” law might one day be challenged.  What is true in football is also true in the effort to keep America’s most popular type of handguns legal and affordable: the best defense is a good offense.

Fallout from Colorado Gun Control Laws Deepens

Colorado-based Magpul Industries, a manufacturer of popular AR-15 ammunition magazines and accessories, announced last week that it will move its corporate headquarters to Texas and its manufacturing operations to Wyoming. The company’s decision, which will affect over 200 employees and 400 supply-chain workers in Colorado, is expected to cost the state over $80 million annually.

Magpul’s relocation is the latest consequence to gun control laws signed into effect last year by Colorado’s governor, John Hickenlooper (D). In September, two Colorado legislators who voted for the laws–a ban on magazines that hold more than 15 rounds, a “universal checks” requirement, and increased fees for gun owners–were recalled and voted out of office.  A third legislator who had voted for the laws soon resigned, rather than face a recall.

Michael Bloomberg and other gun control supporters spent $3 million trying to keep the two recalled anti-gunners–(now former) Sen. Angela Giron and Senate president John Morse–in power. And Giron had said that if she or Morse were voted from office, Bloomberg’s anti-gun group, Mayors Against Illegal Guns, “might as well fold it up.”

However, Giron, Morse and other gun control supporters have since struck a more defiant tone. Giron said “I have not one iota of regret for what I voted on. . . . We will win in the end, because we are on the right side.” Morse scoffed at his removal from office as something “purely symbolic.” And, the Los Angeles Times has reported, gun control supporters now “plan to look for key races in which they can make an impact,” to “show lawmakers that the movement behind stronger gun restrictions will have staying power in elections to come.”

President Obama has said that Colorado’s new gun control laws are “a model for what’s possible,” and the Brady Campaign has gloated that those laws are “still on the books.” However, how long the laws will stay in effect remains to be seen. Colorado lawmakers are drafting legislation that would repeal the laws, and a sizable majority of sheriffs in the state stepped forward to challenge the laws in court on Second Amendment and other grounds.  While a recent ruling narrowed the number of sheriffs eligible to bring the case before the court, that litigation continues.

Detroit Police Chief James Craig has an idea for fighting crime — arm more citizens.

“When we look at the good community members who have concealed weapons permits, the likelihood they’ll shoot is based on a lack of confidence in this police department,” said the chief at a press conference this week, The Detroit News reports.

The chief said he believes the financially crippled city’s residents are feeling safer and violent crime dropped seven percent in 2013. But Craig said that he’s changed his mind over the years over whether citizens should be armed.

He said that when he was on the Los Angeles police force for 28 years, California law made it difficult to get a concealed weapon permit. However, when he became police chief in Portland, Me., in 2009 he changed his mind.

“I got to Maine, where they give out lots of CCWs (carrying concealed weapon permits), and I had a stack of CCW permits I was denying; that was my orientation,” Craig said. “I changed my orientation real quick. Maine is one of the safest places in America. Clearly, suspects knew that good Americans were armed.”

Craig said on a radio show in mid-December that there are a number of people in Detroit with concealed pistol licenses (CPL), and he thinks it’s a deterrent to crime.

“Good Americans with CPLs translates into crime reduction,” said Craig. “I learned that real quick in the state of Maine.”

Craig’s stance is unusual for a police chief, but Michigan Association of Chiefs of Police Director Robert Stevenson said that there are many police officers who have no problem when law-abiding citizens have guns, but they usually try to stay out of those discussions.

Craig’s opinion, though, does not stretch to assault weapons, which he has said should be banned. He’s also called for tight restrictions for online ammunition sales, to regulate high-capacity magazines, and for background checks for gun sales.

There were 15 justifiable homicides in Detroit in 2013, down from 25 in 2012, the Detroit News reports. In most of those cases, citizens were defending themselves by killing criminals.

National Association for Gun Rights Letter

Will your Congressman vote to let President Barack Obama ban wooden stocks and to allow a massive crack-down on firearms manufacturing?

I hope not, but that’s what the Republican-controlled House may be on the verge of doing in a vote that could come later today.

Let me explain.

Last week, I told you about how Chuck Schumer tried to pull a Thanksgiving trick on gun owners.

Schumer was caught red-handed trying to sneak a massive gun ban expansion through the U.S. Senate.

Schumer’s plan calls for extending the so-called “undetectable” gun ban of 1988.

Additionally, he wants to expand it to crack-down on 3D-printing and outlaw manufacturing certain types of receivers, gun moldings, and plastic magazines.

Fortunately, Schumer encountered a set-back.

It sent the gun-grabbers scrambling to find a new strategy to get this anti-gun legislation passed before a crucial December 9th deadline.

The bad news: Insiders are now telling me they’ve found one.

Republican House Speaker John Boehner is prepared to bring it up for a vote in the House on Monday afternoon

This is dangerous.

If Boehner allows it to come up for a vote and pass, it would give Chuck Schumer, Harry Reid, and the rest of the anti-gunners in the Senate the vehicle they need to tack on all of the expanded gun control they’re hoping for.

But it gets worse.

If the so-called “undetectable” gun ban is expanded at all, experts warn that the Obama administration is prepared to use it as an excuse to outlaw as many firearm components as possible — even wooden stocks.

It’s like a ticking time bomb.

With twenty-five gun control Executive Actions taken so far, President Obama and his disgraced Attorney General Eric Holder are holding their breath.

They’re hoping House Republicans will sign-off on renewing the so-called “undetectable” gun ban.

If they do, then Holder and Obama will be free to unleash another tidal wave of Executive Actions and regulations to crack down on as many firearms and components as possible.

I’m afraid it could spell disaster for gun owners.

The good news is, you can help shed light on this latest anti-gun scheme.

Please do not wait until it’s too late.

Please contact your Congressman immediately and urge him or her to oppose extending the so-called “undetectable” gun ban.

*** The congressional switchboard can be reached at (202) 224-3121. Ask to be connected to your Congressman.

When you speak to them, let them know that a vote to reauthorize the so-called “undetectable” gun ban is a vote for more gun control and less freedom.

Urge them to reject Barack Obama and Chuck Schumer’s anti-gun agenda by refusing to allow the so-called “undetectable” gun ban to come up for any vote.

Thank you for taking action right away.

For Freedom,

Dudley Brown
Executive Vice President

P.S. House Republicans may be on the verge of signing-off on a key component of Barack Obama’s anti-gun agenda.

Please contact your Congressman immediately and urge him or her to oppose extending the so-called “undetectable” gun ban.

Texas lawmaker Drew Darby arrested for concealed gun at ABIA

By Mike Ward – American-Statesman Staff

State Rep. Drew Darby faces a third-degree felony charge of illegally carrying a handgun at Austin-Bergstrom International Airport, police said Friday.

An arrest affidavit shows Darby, 66, who is chairman of the House Redistricting Committee and holds seats on the powerful appropriations and higher education committees, was arrested Nov. 14 after airport security screeners found a loaded .380 Ruger pistol in his carry-on bag for a morning flight.

Police said the gun showed up during a routine X-ray and subsequent search of his bag.

Darby told police he “is a concealed (handgun) license holder and stated he forgot the handgun was in his bag. The state’s concealed handgun law does not allow licensees to carry guns through airport security and onto a plane.

Bail was set at $5,000, a court filing shows.

Darby could not be reached for comment Friday. But in a statement, he said he regretted the mistake.

“I accept responsibility for my failure to fully examine my luggage when packing,” he said. “I did not seek or receive special treatment, and that is how it should be.”

Darby, who is seeking reelection to his District 72 House seat, has been a strong gun rights supporter. He is among many lawmakers who carry concealed handguns with a state license, though the exact number is unknown because registration records are kept secret.

According to the Associated Press, the Transportation Safety Administration has set a record for gun seizures at airports this year, more than 1,500 nationwide by October, more than in all of 2012. TSA statistics show 20 were seized during that time at the Austin airport, including 16 that were loaded and four that were unloaded.

Guns OK in post office parking lots, federal judge rules

Just received this from a CHL Student…

By Todd Sperry, CNN
updated 9:30 PM EDT, Thu July 11, 2013

  • U.S. District Court judge ruled in the case of a Colorado gun owner
  • He may keep his weapon in the car in post office parking lot, judge says
  • USPS regulations prohibit having a weapon on post office property
  • It is still illegal to carry a firearm inside a post office

(CNN) — Citizens can legally carry firearms in post office parking lots, a federal judge has ruled.

The case stems from a lawsuit filed by Tab Bonidy, a resident of rural Avon, Colorado, who was prohibited by U.S. Postal Service regulations from carrying his gun on postal service property.

In the town of Avon, the post office doesn’t deliver mail to residents but does provide free post office boxes. Bonidy, who is legally permitted to carry a concealed firearm, was unable to carry the weapon on post office property without violating the law.

U.S. District Court Judge Richard Matsch ruled that the USPS must permit Bonidy to carry his gun in his car in the public parking lot at the post office.

“Mr. Bonidy’s liberty can be accommodated by modifying the regulation to permit Mr. Bonidy to “have ready access to essential postal services… while also exercising his right to self-defense,” Mitsch wrote in the ruling.

Because of the firearms restrictions, Bonidy had to have an employee pick up and deliver his mail at the Avon Post Office, the court said.

While ackowledging that post offices are “sensitive” places and the ban imposed by the USPS regulations is a presumptively valid restriction of that liberty, the parking lot was not a sensitive place. The court said USPS attorneys had failed to present evidence to support enforcement of the regulation on post office parking lots.

In 1972, the Postal Service enacted regulations that prevented open and concealed-carry weapons and explosives on postal property.

A number of high-profile gun violence incidents at post offices across the country has increased the scrutiny on post office safety in recent years.

Despite the ruling, it is still illegal to carry a firearm inside a post office.

Back Door Gun Control –
— EPA Shuts Down Last Lead Smelter
Back Door Gun Control Moves Forward Submitted by Terresa Monroe-Hamilton on October 29, 2013 – 9:51 am EST2 Comments By: Terresa Monroe-Hamilton There are numerous alarming reasons why the US government and the military have been buying up all the ammo. Here’s one of them. Obama and the EPA just shut down the last lead smelting plant in the US. They raised the EPA regulations by 10 fold and it would have cost the plant $100 million to comply. You can own all the guns you want, but if you can’t get ammo, you are out of luck. Remember when Obama promised his minions that he was working on gun control behind the scenes? Welcome to it. Now, all domestic mined lead ore will have to be shipped overseas, refined and then shipped back to the US. Not only will ammo now be even harder to come by, the demand and the process of supply will cause the price to skyrocket even more. And ponder this… there is an excellent chance that Obama will rig the market to where all ammo has to be purchased from a government entity instituting de facto ammo registration. So much for the Second Amendment. There has not been a peep about this in the major news outlets and it is done. With the US no longer producing lead, all supplies will now have to come from China, Australia or Peru, with the overwhelming emphasis on China. More redistribution of wealth; more economic and liberty crippling of the US on tap. The asshats at the EPA (evil protection agency) had this to say: The U.S. Environmental Protection Agency said the company “made a business decision” to shut down the smelter instead of installing pollution control technologies needed to reduce sulfur dioxide and lead emissions as required by the Clean Air Act. The Doe Run Co. announced last year that it had dropped plans to build a new lead processing facility in Herculaneum that would have used a new, cleaner lead production technology. The company cited the $100 million project as too financially risky. The EPA is playing Mafioso I guess — we didn’t make them shut down, they made a business decision. In other words, they couldn’t pay the extortion, so the thugs shut them down. I’m pretty sure that Americans are getting ready to make their own business decision regarding the Marxists and I don’t think it will be pleasant. But Marxists will do or die and are doubling down on the destruction of energy in America, our way of life and the Constitution. The smelting plant has known since 2010 this was coming. They couldn’t stop it and no one else rose up to stop it either. The business had been in production for 120 years and now goes the way of our auto industry. The military’s obsession with ammo was related to security and supply. They knew this was coming too, so they bought up all they could get before the plug was pulled. Screw the average American. It’s as Chris Muir said, he’s not as worried about where the bullets will come from, as much as how the government will deliver them and I’m right there with him on that one. So, back door gun control is moving forward and while we are all distracted with shiny stuff, our Second Amendment rights are just about gone. Obama is one Marxist dictator who is savvy at political chess. He has flanked the Second Amendment. Now it’s our move.

About the new 4 hour CHL class

Texas Senate Bill 864, passed during the 2013 legislative session, became law on September 1, 2013. The law changes the required time spent in the classroom. Before the change the class was a minimum of 10 hours and a maximum of 15 hours. These times were all inclusive so they included the range time, breaks, review and final exam. The new law sets the limits on only classroom instruction. The new law did not delete any required information from the class material, therefore you will spend a minimum of 4 hours and a maximum of 6 hours in classroom instruction. Breaks, review, final exam and range time are in addition to classroom instruction time. According to experience in previous classes, please expect to spend about 7 hours total class day, keep in mind that the law requires this and any class that is a total of 4 hours start to finish cannot be legal. – See more at:
